Terms & Conditions

Please read these terms carefully before participating in any Stamira programme or using our website.

Effective Date: 15 May 2025  ยท  Version 1.0

1. About These Terms

These Terms and Conditions ("Terms") set out the basis on which Stamira ("we", "us", "our") provides endurance and stamina building education programmes, workshops, coaching sessions, and membership services to participants ("you", "your") in Malaysia.

By registering for any programme, purchasing any service, or using this website, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not proceed with enrolment or use of this website.

These Terms are intended to apply to individual adult participants. If you are registering on behalf of another person, you confirm that you have their consent and are authorised to agree to these Terms on their behalf.

2. Our Programmes

Stamira offers the following educational programmes:

  • Steady Pace Workshop โ€” A single group workshop on simple, sustainable pacing habits for everyday activity. Includes a take-home pacing guide. Fee: RM 470 per participant.
  • Endurance Habits Coaching โ€” A ten-week coaching block building gentle stamina habits at a comfortable, gradual pace. Fee: RM 2,250 per block.
  • Year of Steady Progress Membership โ€” An ongoing annual membership with regular sessions, seasonal planning, and access to a library of gentle endurance practices. Fee: RM 4,400 per year.

All programmes are delivered as general movement education and do not constitute regulated professional services of any kind. Session formats, schedules, and facilitators may vary and are subject to availability.

3. Enrolment

Enrolment is confirmed only upon receipt of full payment (or an agreed deposit where applicable) and a written confirmation from Stamira. Submitting an enquiry form or expression of interest does not constitute a binding enrolment.

We reserve the right to decline an enrolment request at our discretion, in which case any payment received will be refunded in full within ten (10) business days.

Participants must be at least 18 years of age. Younger participants may be considered with the written consent of a parent or legal guardian, subject to suitability assessment.

4. Fees & Payment

All fees are quoted in Malaysian Ringgit (RM) and are inclusive of any applicable taxes unless otherwise stated. Payment methods accepted include online bank transfer, e-wallet, and other methods communicated at the time of enrolment.

For the Year of Steady Progress Membership, fees are due annually in advance unless a payment schedule has been agreed in writing. Failure to complete payment by the agreed date may result in a suspension of access until the outstanding balance is settled.

We reserve the right to adjust fees for future enrolment periods. Existing confirmed enrolments will not be affected by fee changes mid-term.

5. Cancellation & Rescheduling

Cancellation by Participant:

  • Cancellations made 14 or more calendar days before the programme start date: full refund, less a RM 50 administrative fee.
  • Cancellations made 7โ€“13 calendar days before the start date: 50% refund of fees paid.
  • Cancellations made fewer than 7 calendar days before the start date: no refund, though a transfer to a future session may be considered at our discretion.

Cancellation by Stamira:

If we cancel a scheduled session or programme for any reason, we will provide participants with at least 48 hours' notice where possible and will offer either a full refund or a transfer to an alternative date at no additional cost.

Rescheduling Requests: Participants wishing to reschedule must notify us in writing at least 5 business days in advance. Rescheduling is subject to availability and a RM 30 administrative fee may apply.

6. Participant Conduct

We aim to maintain a respectful and supportive environment for all participants and facilitators. By participating, you agree to:

  • Engage with programme materials in a courteous and constructive manner.
  • Respect the confidentiality of other participants' personal sharing within group sessions.
  • Notify us promptly of any concerns about session content or your own comfort level.
  • Not record, photograph, or share session content without express written permission from Stamira.

Stamira reserves the right to remove a participant from a programme without refund if their conduct is disruptive, disrespectful, or inconsistent with the spirit of a shared learning environment.

7. Educational Scope

All Stamira programmes are offered as general movement and endurance education โ€” information, tools, and community support to help you build steady, sustainable pacing habits in everyday life.

Stamira programmes do not constitute, and should not be interpreted as, any form of regulated professional service, including physiotherapy, occupational therapy, nursing, or any other regulated health profession under Malaysian law.

Participants are responsible for making their own informed decisions about their personal activity levels and general wellbeing. If you have specific concerns about your suitability for any physical activity, we encourage you to seek appropriate independent guidance before participating.

8. Intellectual Property

All materials provided as part of Stamira's programmes โ€” including pacing guides, session handouts, digital resources, and website content โ€” are the intellectual property of Stamira and are protected under Malaysian copyright law.

Participants are granted a personal, non-transferable licence to use these materials for their own private educational purposes only. You may not reproduce, distribute, adapt, or commercialise any programme materials without our prior written consent.

The Stamira name, logo, and related marks are proprietary to Stamira. Unauthorised use is not permitted.

9. Limitation of Liability

To the fullest extent permitted by Malaysian law, Stamira's liability to any participant arising from or in connection with our programmes or these Terms is limited to the total fees paid by that participant for the relevant programme.

Stamira is not responsible for any indirect, consequential, or special loss or damage arising from participation in our programmes or use of our website.

Nothing in these Terms excludes or limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot lawfully be excluded under Malaysian law, including the Consumer Protection Act 1999.

10. Personal Data

We collect and process personal data in accordance with Malaysia's Personal Data Protection Act 2010 (PDPA). Our Privacy Policy sets out in detail how we collect, use, store, and protect your personal information.

By enrolling in a programme or submitting an enquiry, you consent to the processing of your personal data as described in our Privacy Policy. You may withdraw your consent or request access to your data at any time by contacting us.

12. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. For existing participants enrolled in multi-session programmes, material changes will be communicated directly with at least 14 days' notice.

Your continued participation in any programme or use of this website after the effective date of updated Terms constitutes your acceptance of those changes.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms or your participation in Stamira programmes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
